We regularly advise healthcare providers in business transactions and operations, including mergers and acquisitions, hospital-physician contracting, physician recruitment, medical staff issues (including medical staff organization, governance, bylaws, credentialing, peer review and disciplinary matters), medical office leasing, practice management issues, managed care contracting, labor and employment, and payment and reimbursement.

 

Our attorneys provide advice and assistance with regulatory issues involving licensing and certification requirements, state and/or federal surveys, compliance with anti-referral and anti-kickback laws and regulations, alleged  EMTALA violations, enforcement actions brought by state and/or federal agencies, including citations issued by the state regulatory agency, and assistance with completion of license applications and Medicare and Medi-Cal enrollment forms.

 

We help clients develop and implement compliance programs, assist in compliance audits and provide advice to clients regarding regulatory compliance issues.  We also coordinate covered entity compliance with HIPAA privacy and security requirements, including mitigation and response to efforts in the event of unauthorized disclosures.
